What are Good samaritan laws ?
The Good Samaritan law refers to a legal principle that protects individuals who provide emergency assistance to others in need. The goal of these laws is to encourage people to offer immediate assistance to those in need without having to fear of being held legally liable for any unintentional harm caused while rendering assistance.

Under the Good Samaritan law, a person cannot sue you if you provided emergency services to a loved one who unfortunately passed away. These laws typically shield individuals from liability for ordinary negligence, meaning that as long as you acted reasonably and without gross negligence or misconduct, you are protected from being held legally responsible for any resulting damages.
What is Gross negligence?
The Good Samaritan law offers protection in emergency situations. However, this law does not grant absolute immunity in cases involving gross negligence, wanton misconduct, or intentional harm. If a person's actions go beyond the scope of ordinary negligence, they may still be held liable for their behavior.
Can I Sue a Physician in the Event of Wrongful death?
While Good Samaritan laws protect people who provide emergency assistance, they do not apply to healthcare professionals, including physicians, when they are acting within the scope of their professional duties. Healthcare professionals are expected to provide a certain standard of care and are subject to medical malpractice laws and regulations.

California law recognizes that healthcare professionals, such as physicians, have specialized training and expertise, and they are held to a higher standard of care when providing medical assistance.
If a physician provides emergency medical care in a situation where their actions fall below the standard of care, they can potentially be held liable for medical malpractice.
If you believe that a physician's negligence resulted in the loss of your loved one, you must speak with a wrongful death lawyer as soon as possible.
